9Dear Mary:

13This letter outlines the steps that we have taken
14to establish the Regents' copyright on the parts of the Fourth Berkeley
15Software Distribution (4.2BSD and 4.3BSD) that are derived from work
16done at the University of California, Berkeley.
17Briefly, we have inserted copyright notices into each of the separate
18source files which contain original Berkeley work and major Berkeley additions.
19The notices were inserted so
20that the copyright notice is included in the executable programs
21when they are compiled from the copyrighted source.
22The copyright notices in the
23printed documentation were also verified for completeness.
24A copyright notice is put on the label of each tape
25shipped with the distribution.
26These changes were all completed in time for the
274.3BSD release of the Fourth Berkeley Software Distribution.
28.pp
29The copyright notices have been placed in each source file that was
30originally written at Berkeley, or which was rewritten or substantially
31modified at Berkeley such that the majority of the program is of
32Berkeley origin.
33In addition, programs which have been modified to the extent that
34their function is significantly improved have been marked
35with the University copyright.
36In the latter case, although there may be somewhat less than the 90%
37Berkeley derivation we discussed,
38I believe it to be reasonable for those few programs that it covers.
39Other programs that have not been modified,
40or have been less substantially modified at Berkeley,
41have not been marked as copyrighted.
42Some programs received as user contributed software from sources other
43than 32/V or University work have been marked with copyrights
44agreed to by the contributor.
45.pp
46The copyright notices that have been inserted are of two forms.
47The first form is for programs that still contain AT&T proprietary
48code and thus require an AT&T license as well as a Berkeley license:

58The above notice is the one used throughout the 4.3BSD.
59The second, which appears immediately below, is for programs that do not
60contain AT&T code,
61and have already been inserted into the tahoe release.

99These notices are surrounded by delimiters so that they are ignored
100by the programs that need to read the file.
101For those programs that originated with 4.2BSD rather than 4.1BSD
102or before, the copyright date is 1983.
103In the source files comprising a single program,
104one notice of the form
105.nf

109"@(#) Copyright (c) 1983 The Regents of the University of California.\en\e

111.sp

113.fi
114has also been included.
115The part of the notice between quotes is included
116in the executable binary program after compilation,
117and is displayed when checking the version of the program.

121A list of the files to be copyrighted is attached as Appendix A.
122.pp
123We are now preparing
124to reclaim the copyright on the material that was distributed
125without copyright notices in 4.2BSD.
126We intend to send a letter, a draft
127of which is attached, to all the existing licensees of 4.2BSD.
128This letter will require each licensee to insert the copyright notices
129in existing copies of the licensed material, and to similarly notify
130anyone to whom they have licensed 4.2BSD sources.
131To simplify the procedure,
132we will not annotate the list of files to indicate which of the two copyright
133notices should be used;
134instead we will instruct them to put the more restrictive
135copyright requiring an AT&T license (appearing first above)
136in all the listed files.
137.pp
138Alternatively, licensees of 4.2BSD may replace their existing
139licensed material with the 4.3BSD versions.
140We expect that most 4.2BSD sites will choose the approach of upgrading.
