1.lh 2.in 3i 3 4.in -3i 5.nf 6Mary McDonald 7University General Counsel 8.sp 3 9Dear Mary: 10.fi 11.sp 12.pp 13This letter outlines the steps that we proposed 14to establish the Regent's copyright on the parts of the Fourth Berkeley 15Software Distribution (4.2BSD and 4.3BSD) that are derived from work 16done at the University of California, Berkeley. 17Briefly, we plan to insert copyright notices into each of the separate 18source files for original Berkeley work and major Berkeley additions. 19This will be done in such a way 20that the copyright notice will be included in the executable programs 21when they are compiled from the copyrighted source. 22We will also place a copyright notice on the label of each tape 23shipped with the distribution, and examine the copyright notices in the 24printed documentation for completeness. 25The next release of the Fourth Berkeley Software Distribution, 4.3BSD, 26will include all of these changes. 27.pp 28In order to reclaim the copyright on the material which was distributed 29without copyright notices in 4.2BSD, we will send a letter, a draft 30of which is attached, to all of the existing licensees of 4.2BSD 31and to AT & T. 32This letter will require each licensee to insert the copyright notices 33in existing copies of the licensed material, and to similarly notify 34anyone to whom they have licensed 4.2BSD sources. 35I have not specifically addressed the question of binary-only 36redistributions of 4.2BSD, which would not include most of the 37files requiring modification. 38Alternatively, licensees of 4.2BSD may replace their existing 39licensed material with the 4.3BSD versions. 40.pp 41The copyright notices will be placed in each source file that was 42originally written at Berkeley, or which was rewritten or substantially 43modified at Berkeley such that the majority of the program was of 44Berkeley origin. 45In addition, programs which have been modified to the extent that 46their function is significantly improved will also be marked 47with the University copyright. 48This distinction is different than the 90% derivation that we discussed, 49but I believe it to be reasonable for those few programs that it covers. 50Other programs that have not been modified, 51or have been less substantially modified at Berkeley, 52will not be marked as copyrighted. 53Programs received from sources other than 32/V or University work 54will also not be marked. 55.pp 56The copyright notices to be inserted are of the form 57.nf 58.in+1i 59 60Copyright (c) 1980 Regents of the University of California. 61All rights reserved.
