1Statement of Purpose 2 3The laws of most jurisdictions throughout the world automatically confer 4exclusive Copyright and Related Rights (defined below) upon the creator 5and subsequent owner(s) (each and all, an "owner") of an original work 6of authorship and/or a database (each, a "Work"). 7 8Certain owners wish to permanently relinquish those rights to a Work for 9the purpose of contributing to a commons of creative, cultural and 10scientific works ("Commons") that the public can reliably and without 11fear of later claims of infringement build upon, modify, incorporate in 12other works, reuse and redistribute as freely as possible in any form 13whatsoever and for any purposes, including without limitation commercial 14purposes. These owners may contribute to the Commons to promote the 15ideal of a free culture and the further production of creative, cultural 16and scientific works, or to gain reputation or greater distribution for 17their Work in part through the use and efforts of others. 18 19For these and/or other purposes and motivations, and without any 20expectation of additional consideration or compensation, the person 21associating CC0 with a Work (the "Affirmer"), to the extent that he or 22she is an owner of Copyright and Related Rights in the Work, voluntarily 23elects to apply CC0 to the Work and publicly distribute the Work under 24its terms, with knowledge of his or her Copyright and Related Rights in 25the Work and the meaning and intended legal effect of CC0 on those 26rights. 27 281. Copyright and Related Rights. A Work made available under CC0 may be 29protected by copyright and related or neighboring rights ("Copyright and 30Related Rights"). Copyright and Related Rights include, but are not 31limited to, the following: 32 33 i. the right to reproduce, adapt, distribute, perform, display, 34 communicate, and translate a Work; 35 ii. moral rights retained by the original author(s) and/or 36 performer(s); 37 iii. publicity and privacy rights pertaining to a person's image or 38 likeness depicted in a Work; 39 iv. rights protecting against unfair competition in regards to a 40 Work, subject to the limitations in paragraph 4(a), below; 41 v. rights protecting the extraction, dissemination, use and reuse 42 of data in a Work; 43 vi. database rights (such as those arising under Directive 96/9/EC 44 of the European Parliament and of the Council of 11 March 1996 45 on the legal protection of databases, and under any national 46 implementation thereof, including any amended or successor 47 version of such directive); and 48 vii. other similar, equivalent or corresponding rights throughout the 49 world based on applicable law or treaty, and any national 50 implementations thereof. 51 522. Waiver. To the greatest extent permitted by, but not in 53contravention of, applicable law, Affirmer hereby overtly, fully, 54permanently, irrevocably and unconditionally waives, abandons, and 55surrenders all of Affirmer's Copyright and Related Rights and associated 56claims and causes of action, whether now known or unknown (including 57existing as well as future claims and causes of action), in the Work 58(i) in all territories worldwide, (ii) for the maximum duration provided 59by applicable law or treaty (including future time extensions), (iii) in 60any current or future medium and for any number of copies, and (iv) for 61any purpose whatsoever, including without limitation commercial, 62advertising or promotional purposes (the "Waiver"). Affirmer makes the 63Waiver for the benefit of each member of the public at large and to the 64detriment of Affirmer's heirs and successors, fully intending that such 65Waiver shall not be subject to revocation, rescission, cancellation, 66termination, or any other legal or equitable action to disrupt the quiet 67enjoyment of the Work by the public as contemplated by Affirmer's 68express Statement of Purpose. 69 703. Public License Fallback. Should any part of the Waiver for any reason 71be judged legally invalid or ineffective under applicable law, then the 72Waiver shall be preserved to the maximum extent permitted taking into 73account Affirmer's express Statement of Purpose. In addition, to the 74extent the Waiver is so judged Affirmer hereby grants to each affected 75person a royalty-free, non transferable, non sublicensable, non 76exclusive, irrevocable and unconditional license to exercise Affirmer's 77Copyright and Related Rights in the Work (i) in all territories 78worldwide, (ii) for the maximum duration provided by applicable law or 79treaty (including future time extensions), (iii) in any current or 80future medium and for any number of copies, and (iv) for any purpose 81whatsoever, including without limitation commercial, advertising or 82promotional purposes (the "License"). The License shall be deemed 83effective as of the date CC0 was applied by Affirmer to the Work. 84Should any part of the License for any reason be judged legally invalid 85or ineffective under applicable law, such partial invalidity or 86ineffectiveness shall not invalidate the remainder of the License, and 87in such case Affirmer hereby affirms that he or she will not 88(i) exercise any of his or her remaining Copyright and Related Rights in 89the Work or (ii) assert any associated claims and causes of action with 90respect to the Work, in either case contrary to Affirmer's express 91Statement of Purpose. 92 934. Limitations and Disclaimers. 94 95 i. No trademark or patent rights held by Affirmer are waived, 96 abandoned, surrendered, licensed or otherwise affected by this 97 document. 98 ii. Affirmer offers the Work as-is and makes no representations or 99 warranties of any kind concerning the Work, express, implied, 100 statutory or otherwise, including without limitation warranties 101 of title, merchantability, fitness for a particular purpose, non 102 infringement, or the absence of latent or other defects, 103 accuracy, or the present or absence of errors, whether or not 104 discoverable, all to the greatest extent permissible under 105 applicable law. 106 iii. Affirmer disclaims responsibility for clearing rights of other 107 persons that may apply to the Work or any use thereof, including 108 without limitation any person's Copyright and Related Rights in 109 the Work. Further, Affirmer disclaims responsibility for 110 obtaining any necessary consents, permissions or other rights 111 required for any use of the Work. 112 iv. Affirmer understands and acknowledges that Creative Commons is 113 not a party to this document and has no duty or obligation with 114 respect to this CC0 or use of the Work. 115
